Lasting Powers of Attorney (LPAs) are useful mechanisms for enabling those in whom you have total trust to manage your affairs and make decisions on your behalf when you might not be in a position to do so yourself. While LPAs are often used to assist elderly donors who, for whatever reason, can no longer manage their day-to-day affairs on a practical basis, there are other circumstance in which anybody may find an LPA appropriate.
LPAs can be used to enable others to make decisions on your behalf either in relation to financial affairs or matters relating
to your health and welfare. These LPAs are separate and distinct.
Creating a Power of Attorney requires careful thought. In most circumstances, once registered, your attorneys will "stand in your shoes" with full authority to make decisions on your behalf (they must, of course, always act in your best interests). You may, however, direct and control how Attorneys can act and you are able, in some areas, to impose certain limitations on the scope of the decisions they can make. You can also determine how Attorneys must make decisions if you appoint more than one Attorney. In addition, you may make expressions of wishes informing your Attorneys of your preferences in certain circumstances; such expressions of wishes are not necessarily binding upon your Attorneys but they should always take them into account when acting on your behalf.
